Important Changes for Carers!

Mental Capacity Act 2005 and Advance Care Planning


The Mental Capacity Act (2005) came into effect from April 2007. Many people will be directly affected by the provisions of the Act. If you own, manage or work in a care home for older people, can you answer ‘yes’ to the following questions?

  • Did you know that everybody is assumed to have capacity unless proven otherwise?
  • Do you know how to test for mental capacity?
  • For someone who lacks capacity, do you know who must be involved in the decision for them to move to a care home, when they have no representative to speak for them?
  • Did you know that someone who does not lack capacity will have the right to make unwise or eccentric decisions?
  • Did you know that one adult cannot consent to treatment for another person who lacks mental capacity, unless they have a Lasting Power of Attorney?
  • Do you feel confident and competent to assist a resident to complete an advance care planning document?

If you answered ’no’ to any of these questions, then the SHARP courses will help.

SHARP Record & Plans hold regular learning events for care home staff to introduce the Act and for the development of advance care plans for care homes. These course are specifically designed for those working in care homes for older people. All learning materials are related directly to working with this group of people.
